AGREEMENT BETWEEN TOWN SQUARE INTERNET AND REGISTERED USER

The undersigned registered user, hereinafter referred to as the "User", for and in consideration of authorization to access and utilize the services provided by and through Town Square Internet, hereinafter referred to as "TSI", agrees to accept and abide by the following terms and conditions for access and usage of the TSI system:

Quailty of Service. Quality of service is determined by the signal strength. If YOU ARE A MOBLE USER you need to understand that the speed and ability to connect can change drastically depending on where you are located. Noise problems and inference affect mobile uses or laptop users more than they do CPE customers. We do not guarantee the connection or speeds unless everything is installed or place in an optimum conditions.

Revocable privilege. Access and use of the TSI system is a privilege. Which may be revoked by TSI at any time, with or without prior notice to the User, upon a reasonable suspicion that the User has committed, or has knowingly permitted any other person to commit, unauthorized or improper use of the TSI system. Unauthorized or improper use of the TSI system includes, but is not limited to: Use of the system for any purpose or activity that is prohibited by federal, state, or local laws, rules, or regulations; and knowingly permitting an unauthorized person to access the TSI system. The User specifically agrees not to permit any other person to use User’s identification number or password to access the TSI system.

Reservation of rights. TSI expressly reserves the right to access, review, edit or delete any and all material stored in TSI files and programs which are generally accessible to users.

TSI’s disclaimer. Material and information contained in or accessible through the TSI system is intended only for general, nonspecific, informational purposes, uses and applications. TSI does not expressly or impliedly warrant the quality, accuracy, veracity, completeness, or authenticity of any materials or information contained in or accessible through the TSI system, nor does TSI represent that the TSI system is designed or intended for any specific purpose, use, or application. TSI shall not be liable for any direct or indirect, incidental, or consequential damages, including lost data, lost information, or lost profits, sustained or incurred by any person in connection with the use, nonuse, or operation of the TSI system.

TSI excercises no control whatever over the content of the information passing over its network. TSI makes no warranties of any kind, either expressed or implied, for the service it is providing. We also disclaim any warranty of merchantability or fitness for a particular purpose. We will not be responsible for any damage your suffer. This includes, but not limited to, loss of data resulting from delays, nondeliveries, misdeliveries, or service interruptions caused by our negligence or your errors or omissions. We specifically deny responsibility for the accuracy or quality of information obtained through our service.

Defense and indemnification. The User agrees to abide by all rules and regulations now in effect or hereafter promulgated by TSI in the user’s access and use of the TSI system. The User agrees to defend, indemnify, and hold harmless TSI, its members, its governing board, and its employees, agents, and officers for any and all manner of suits, claims, causes of action, and judgments arising out the unauthorized or improper use of the TSI system by the User or by any person improperly using the TSI system with the knowledge and consent of the User.

User’s disclaimer. The User understands and agrees that no professional relationship such as attorney-client, doctor-patient, counselor-patient, accountant-client, or similar relationship is or can be established through the access and use of the TSI system by the User; that User will not seek to establish or claim there has been established, any such professional relationship; and that those persons directly or indirectly providing advice or information to User through the TSI system are entitled to rely on User’s disclaimer as set forth in this paragraph as an inducement to provide materials and information to the TSI system.

Acceptable Use. TSI’s connection can be used for any lawful purpose. Transmission of any material in violation of any U.S. or state regulation is prohibited. This includes, but is not limited to: copyrighted material, material legally judged to be threatening or obscene, or material protected by trade secret. You agree to indemnify and hold us harmless from any claims resulting from your use of the service which damages you or another party. Any access to other networks connected to TSI must comply with the rules for that other network. This specifically, but not exclusively, includes NSFNET. Use of connection to the Internet through TSI is for private use only and may not be resold in any form.

Refund Policy. No refunds will be granted after the first 15 days of service. Within the first 15 days of service, if circumstances arise beyond the User’s control, and the User is unable to use TSI’s service, a refund shall be granted with the exception of a $10.00 processing fee.
